{"id":15233,"date":"2024-01-12T09:00:00","date_gmt":"2024-01-12T12:00:00","guid":{"rendered":"https:\/\/www.agenciainfra.com\/blog\/?p=15233"},"modified":"2026-03-13T09:43:05","modified_gmt":"2026-03-13T12:43:05","slug":"antt-poe-em-audiencia-publica-norma-para-regime-de-recuperacao-regulatoria-de-concessoes-rodoviarias","status":"publish","type":"post","link":"https:\/\/agenciainfra.com\/blog\/antt-poe-em-audiencia-publica-norma-para-regime-de-recuperacao-regulatoria-de-concessoes-rodoviarias\/","title":{"rendered":"ANTT p\u00f5e em audi\u00eancia p\u00fablica norma para Regime de Recupera\u00e7\u00e3o Regulat\u00f3ria de concess\u00f5es rodovi\u00e1rias"},"content":{"rendered":"\n<p class=\"has-text-align-right\"><strong>Dimmi Amora, da Ag\u00eancia iNFRA<\/strong><\/p>\n\n\n\n<p>A&nbsp;ANTT&nbsp;(Ag\u00eancia Nacional de Transportes Terrestres) abre nos pr\u00f3ximos dias&nbsp;audi\u00eancia&nbsp;p\u00fablica&nbsp;para&nbsp;criar uma&nbsp;norma&nbsp;que instituir\u00e1 o&nbsp;Regime&nbsp;de&nbsp;Recupera\u00e7\u00e3o&nbsp;Regulat\u00f3ria&nbsp;para&nbsp;as concession\u00e1rias de rodovias federais.&nbsp;<br><br>O modelo ser\u00e1 formalizado dentro da proposta de novo regulamento de&nbsp;concess\u00f5es, o RCR 4, ao qual a ag\u00eancia aprovou na sua \u00faltima reuni\u00e3o de diretoria de 2023 a abertura de consulta&nbsp;p\u00fablica&nbsp;para&nbsp;o in\u00edcio de 2024.<br><br>A proposta \u00e9 que, se a concession\u00e1ria est\u00e1 por dois anos seguidos&nbsp;em&nbsp;descumprimento ou qualificada&nbsp;para&nbsp;relicita\u00e7\u00e3o no PPI (Programa de Parcerias de Investimentos), poder\u00e1 solicitar entrar nesse modelo, que prev\u00ea um plano espec\u00edfico de mudan\u00e7as contratuais&nbsp;para&nbsp;que ela possa fazer a troca de controle.<br><br>\u00c9 a regulamenta\u00e7\u00e3o de algo que j\u00e1 ocorreu na pr\u00e1tica, quando a ag\u00eancia estabeleceu normas&nbsp;para&nbsp;a troca de controle da concession\u00e1ria da BR-163\/MT, que passou da OTP (Odebrecht Transport)&nbsp;para&nbsp;a MT PAR, no ano passado.<br><br>&#8220;\u00c9 uma remodelada no contrato&nbsp;para&nbsp;uma venda privada&#8221;, explicou Fernando Feitosa, gerente da Superintend\u00eancia de Rodovias da&nbsp;ANTT, lembrando que a ag\u00eancia quer discutir no per\u00edodo de audi\u00eancias como atuar\u00e1&nbsp;em&nbsp;casos de frustra\u00e7\u00e3o da venda, se a concession\u00e1ria ter\u00e1 que sair ou continuar no contrato remodelado.<br><br>O&nbsp;regime&nbsp;de&nbsp;recupera\u00e7\u00e3o&nbsp;regulat\u00f3ria&nbsp;chegou a ser avaliado&nbsp;para&nbsp;constar no RCR 3, que teve sua resolu\u00e7\u00e3o recentemente aprovada pela diretoria da&nbsp;ANTT. Mas&nbsp;quando foi colocado&nbsp;em&nbsp;consulta nessa proposta houve muitas d\u00favidas das empresas. Por isso, a ag\u00eancia entendeu que seria melhor amadurecer mais a ideia que vai agora&nbsp;para&nbsp;avalia\u00e7\u00e3o no RCR 4.<br><br><strong>Audi\u00eancia&nbsp;em&nbsp;21 de fevereiro<\/strong><br>De acordo com a&nbsp;ANTT, o per\u00edodo de contribui\u00e7\u00f5es da&nbsp;audi\u00eancia&nbsp;p\u00fablica&nbsp;ser\u00e1 de 15 de janeiro a 29 de fevereiro. A previs\u00e3o \u00e9 que a sess\u00e3o telepresencial ocorra&nbsp;em&nbsp;21 de fevereiro, na sede da ag\u00eancia,&nbsp;em&nbsp;Bras\u00edlia (DF).<br><br>Feitosa afirmou que a rea\u00e7\u00e3o \u00e0 proposta do RCR 4 apresentada nas reuni\u00f5es participativas que precederam a abertura da&nbsp;audi\u00eancia&nbsp;p\u00fablica, por parte das empresas e demais interessados, foi melhor que a esperada.<br><br>Segundo ele, a ideia geral do regulamento \u00e9 que o mau prestador de servi\u00e7o ter\u00e1 uma fiscaliza\u00e7\u00e3o mais intensa por parte da ag\u00eancia e o que estiver cumprindo o seu contrato ter\u00e1 uma presen\u00e7a menor da fiscaliza\u00e7\u00e3o. Com isso, ser\u00e1&nbsp;buscada uma nova dosimetria de multas, por exemplo, al\u00e9m de medidas preventivas.<br><br><strong>Autoden\u00fancia<\/strong><br>As concession\u00e1rias tamb\u00e9m poder\u00e3o autodenunciar-se por alguma infra\u00e7\u00e3o e, com isso, estabelecer com a ag\u00eancia um plano de cura sobre determinado problema a ser sanado.&nbsp;<br><br>&#8220;Teve uma chuva forte. A empresa viu que encheu de buraco a pista e a ag\u00eancia ainda n\u00e3o viu. A empresa faz a den\u00fancia e diz&nbsp;em&nbsp;quanto tempo vai resolver&#8221;, explicou Feitosa, que informou que atrasos&nbsp;em&nbsp;obras previstas n\u00e3o entram nesse tipo de den\u00fancia espont\u00e2nea e haver\u00e1 travas&nbsp;para&nbsp;n\u00e3o ser repetitivo.<br><br>Parte do RCR 4 \u00e9 uma mudan\u00e7a interna da ag\u00eancia no modelo de fiscaliza\u00e7\u00e3o. Foram estabelecidos tr\u00eas n\u00edveis de fiscaliza\u00e7\u00e3o&nbsp;para&nbsp;que se possa ter um rito mais regular. Mas haver\u00e1 tamb\u00e9m a possibilidade de fiscaliza\u00e7\u00f5es extraordin\u00e1rias, n\u00e3o previstas no modelo.<br><br><strong>Sem ades\u00e3o obrigat\u00f3ria<\/strong><br>Por isso, segundo Feitosa, o RCR 4 n\u00e3o prev\u00ea a ades\u00e3o obrigat\u00f3ria das concession\u00e1rias&nbsp;para&nbsp;que ele possa ser implementado nos contratos existentes. O mesmo ocorre&nbsp;para&nbsp;o RCR 1 (j\u00e1&nbsp;em&nbsp;vigor) e o RCR 5 (em&nbsp;per\u00edodo de reuni\u00e3o participativa no momento).&nbsp;<br><br>O RCR 1 trata de elementos gerais dos contratos e direitos dos usu\u00e1rios e se tornou a Resolu\u00e7\u00e3o 5.950. J\u00e1 o RCR 5 vai tratar de formas de encerramento contratual. Nele, ser\u00e1 regulamentado, por exemplo, o modelo de operador tempor\u00e1rio das&nbsp;concess\u00f5es.<br><br><strong>RCR 5<\/strong><br>Em&nbsp;casos recentes,&nbsp;em&nbsp;que os prazos previstos&nbsp;para&nbsp;a relicita\u00e7\u00e3o de rodovias foram ultrapassados, a ag\u00eancia ficou sem instrumentos&nbsp;para&nbsp;manter a concess\u00e3o operando no modelo privado e teria que passar a estrada&nbsp;para&nbsp;o DNIT (Departamento Nacional de Infraestrutura de Transportes), que n\u00e3o pode manter a cobran\u00e7a de ped\u00e1gio.<br><br>A ideia \u00e9 que, nesse tipo de situa\u00e7\u00e3o, um privado possa oper\u00e1-la de maneira provis\u00f3ria, evitando a paralisa\u00e7\u00e3o dos servi\u00e7os prestados e a cobran\u00e7a de ped\u00e1gio.
