{"id":8253,"date":"2021-09-10T11:00:00","date_gmt":"2021-09-10T14:00:00","guid":{"rendered":"https:\/\/www.agenciainfra.com\/blog\/?p=8253"},"modified":"2021-09-09T11:05:29","modified_gmt":"2021-09-09T14:05:29","slug":"infradebate-o-novo-marco-legal-ferroviario","status":"publish","type":"post","link":"https:\/\/agenciainfra.com\/blog\/infradebate-o-novo-marco-legal-ferroviario\/","title":{"rendered":"iNFRADebate: O novo Marco Legal Ferrovi\u00e1rio"},"content":{"rendered":"\n<p class=\"has-text-align-right\"><strong>Alberto Sogayar*<\/strong><\/p>\n\n\n\n<p>Com o advento da Medida Provis\u00f3ria 1.065\/2021, que disp\u00f5e sobre a explora\u00e7\u00e3o do servi\u00e7o de transporte ferrovi\u00e1rio, o tr\u00e2nsito e o transporte ferrovi\u00e1rios e as atividades desempenhadas pelas administradoras ferrovi\u00e1rias e pelos operadores ferrovi\u00e1rios independentes, institui o Programa de Autoriza\u00e7\u00f5es Ferrovi\u00e1rias, e d\u00e1 outras provid\u00eancias, o chamado Marco Legal das Ferrovias, n\u00e3o resta d\u00favidas de que haver\u00e1 aumento de interesse e, por via de consequ\u00eancia, aumento de investimentos pelo mercado privado.<\/p>\n\n\n\n<p>Esse dispositivo pretende reduzir a burocracia para a implanta\u00e7\u00e3o de novos modais ferrovi\u00e1rios, al\u00e9m do aproveitamento de in\u00fameros trechos ociosos e na presta\u00e7\u00e3o do servi\u00e7o de transporte ferrovi\u00e1rio.<\/p>\n\n\n\n<p>Com efeito, uma das inova\u00e7\u00f5es que merece elogio est\u00e1 prevista no Cap\u00edtulo II (artigo 6\u00ba ao 16\u00ba da MP), que trata da permiss\u00e3o da constru\u00e7\u00e3o de novas ferrovias por autoriza\u00e7\u00e3o, tr\u00e2mite este que j\u00e1 ocorre na explora\u00e7\u00e3o de outros setores, tais como telecomunica\u00e7\u00f5es, energia el\u00e9trica, portu\u00e1rio e aeroportu\u00e1rio.&nbsp;<\/p>\n\n\n\n<p>Esse instrumento tamb\u00e9m poder\u00e1 ser utilizado para a explora\u00e7\u00e3o de trechos sem opera\u00e7\u00e3o, devolvidos, desativados ou ociosos.<\/p>\n\n\n\n<p>A medida ainda permite que as atuais concession\u00e1rias, caso prejudicadas pela entrada em opera\u00e7\u00e3o de ferrovia autorizada ou caso se comprometam com a expans\u00e3o do servi\u00e7o, possam migrar para o novo regime jur\u00eddico de autoriza\u00e7\u00e3o. Essa migra\u00e7\u00e3o n\u00e3o prejudicar\u00e1 obriga\u00e7\u00f5es contidas nos atuais contratos quanto a investimentos e manuten\u00e7\u00e3o do transporte de passageiros.<\/p>\n\n\n\n<p>Vejamos alguns pontos relevantes relativos \u00e0 autoriza\u00e7\u00e3o prevista na MP.<\/p>\n\n\n\n<p>O prazo de vig\u00eancia da autoriza\u00e7\u00e3o poder\u00e1 ser de at\u00e9 noventa e nove anos, prorrog\u00e1veis por per\u00edodos iguais e sucessivos, desde que a infraestrutura esteja em opera\u00e7\u00e3o e haja manifesta\u00e7\u00e3o pr\u00e9via e expressa de interesse do operador autorizat\u00e1rio, conforme se depreende do contido no art. 6\u00ba, \u00a71\u00ba, I e II.<\/p>\n\n\n\n<p>Quando o Minist\u00e9rio da Infraestrutura apreciar o requerimento de autoriza\u00e7\u00e3o, dever\u00e1 analisar a converg\u00eancia do projeto com a pol\u00edtica nacional de transporte ferrovi\u00e1rio, conforme o previsto no art. 7\u00ba, \u00a72\u00ba, I, \u00a75\u00ba, II, e, com o suporte da ANTT (Ag\u00eancia Nacional de Transportes Terrestres), avaliar\u00e1 a compatibilidade locacional do projeto com outras infraestruturas implantadas ou outorgadas (art. 7\u00ba, \u00a73\u00ba).<\/p>\n\n\n\n<p>O chamamento p\u00fablico poder\u00e1 ser realizado a qualquer tempo, por iniciativa do Minist\u00e9rio da Infraestrutura, tendo por objeto a autoriza\u00e7\u00e3o de ferrovias n\u00e3o implantadas, sem opera\u00e7\u00e3o, em processo de devolu\u00e7\u00e3o ou desativa\u00e7\u00e3o, outorgadas a empresas estatais (exceto as subconcedidas), al\u00e9m daquelas consideradas ociosas, conforme se depreende do art. 9\u00ba da MP.<\/p>\n\n\n\n<p>Pagamento de outorga e processo seletivo p\u00fablico: edital do chamamento p\u00fablico deve indicar contrapartida m\u00ednima, inclusive a possibilidade de pagamento de outorga (art. 10, III).<\/p>\n\n\n\n<p>Havendo mais de um interessado, a ANTT disciplinar\u00e1 processo seletivo p\u00fablico (art. 11, II), que ter\u00e1, como crit\u00e9rio de julgamento, o maior lance (inclu\u00edda a possibilidade de pagamento de outorga), observados, em qualquer hip\u00f3tese, os princ\u00edpios da legalidade, da impessoalidade, da moralidade, da publicidade e da efici\u00eancia (art. 11, par\u00e1grafo \u00fanico).<\/p>\n\n\n\n<p>A autoriza\u00e7\u00e3o poder\u00e1 ser extinta na hip\u00f3tese de n\u00e3o obten\u00e7\u00e3o de licen\u00e7as por raz\u00f5es imput\u00e1veis ao autorizat\u00e1rio (art. 13, \u00a73\u00ba).
